Bill would ban mentally ill from guns

Judgments, treatments to be reported

More than a year after a mentally ill student killed 32 people at Virginia Tech, Louisiana legislators are considering a bill to prohibit similarly unstable people from buying firearms.

House Bill 76 would require courts in Louisiana to report orders regarding mental health judgments and treatments to the state Department of Public Safety and Corrections.

The department, in turn, would provide the information to the FBI’s background check database, used when people try to buy a firearm.

Tara Mica, a lobbyist with the National Rifle Association-Institute for Legislative Action, said the U.S. Congress recently passed improvements to the National Instant Criminal Background Check System, or NICS, encouraging states to report mental health information to the FBI.

Mica said the changes were in response to the Virginia Tech shootings in April 2007, when a mentally ill student gunned down 32 people on campus before killing himself.

Mica said the shooter had been ordered by a court to receive outpatient mental health treatment.

“Because Virginia didn’t report that record up, it was not included in the NICS system when that person went to purchase a firearm,” she told the Louisiana House Administration of Criminal Justice committee Thursday.

Under HB76, people immediately flagged are those who are ordered by a court to receive inpatient mental health services, those restricted based on their mental health, those with a mental retardation committed to a care facility, those determined mentally incapable of proceeding with a criminal trial, or those acquitted in a criminal case by reason of insanity.

The measure, sponsored by state Rep. Austin Badon, D-New Orleans, won approval in the committee and will next be considered on the House floor.

Rep. Barbara Norton, D-Shreveport, said it was a good bill, considering another measure to allow college students to carry guns on campus is up for debate in the House.

“One of my concerns were that if someone had a mental problem, and they were able to get their hand on a gun or be able to get the license, we would really have even a larger problem than we have with just someone 21 having a gun,” Norton said.

Mark Thomas, testifying on behalf of nonprofit Mental Health America of Louisiana, said HB76 is too broad and would restrict anyone who receives any sort of mental health treatment.

“You can receive treatment for a variety of reasons,” he said.

I think its a good Idea to ban Guns from Mentally ill.. I just dont see how its going to be inforced. Where there is a will to do wrong they will find a way.

It's already illegal for a mentally ill person to get a gun. Why does everyone think the only people on a college campus that want to be able to carry their conealed handguns are students? There are hundreds or more employee's that work on campus that might want to carry. Babara Norton writes, Rep. I guess she's never read any of the forms you have to fill out for the Louisiana State Police to get a CHP. I wish some of these so called "law makers" would read some of our laws we already have. Cleo "Urkel" introduced a bill back when he was a "law maker" that wanted it to be illegal to take a gun in a polling place. Guess what Cleo it's already illegal. I have a Louisiana Concealed Handgun Permit and that's one of the places I can't carry. Plus alot of Polling places are in schools so the gun free zones cover that. So "Law Makers" if you don't know what you are taking about please ask someone that does.

Other than that they are in the legislature, how can you tell someone is mentally ill? Certifiable? There are many people too crazy or stupid to be armed. You don't think so? Well, go to any gun show, hunting camp or LSU football game and see for yourself. But seriously, everybody packing will mean many folks shot over trivial matters. Parking lot beefs, no fries with that, wrong bumpersticker; soccer rage. This is such a stupid state.

Well seelieme, looks like you've been drinking the Brady bunch Kool-aid. So you think everybody is going to start shooting each other over french fires? Why don't you check with the Louisiana State Police Concealed Handgun Section and ask them how many Louisiana residents with a Lousiana Concealed Handgun Permit have been involved in a shooting. I did check and the person I talked to said since she's been there "2000" she can only remember one of two. Yep we are a wild bunch. How many shooting were there in Baton Rouge last night? It wasn't us shooting.

Seelieme you're being dishonest. I attend many gun shows per year, go to competitive shooting events and attend college sporting events and have never, ever felt as though my partisanship on any topic rendered me in danger. Since you've put the premise that everybody packing will result in result in Dodge City after the cattle drive, please provide some evidence so those of us who support the theory that an armed society is a polite society can be swayed. Otherwise, preface your remarks with "In my opinion..." so we can move on in search of rational debate.

seelieme, Last time I crossed the State line there was no fence so anytime you want to leave our "stupid state" feel to go.
