BR nightclub worker sues over wounds

A nightclub employee, indicted for allegedly shooting at three Baton Rouge police officers a year ago, is suing the city for multiple bullet wounds the officers inflicted on him.
David Wayne Robinson, 30, filed the lawsuit in Baton Rouge federal court late Friday.
It was assigned to Chief U.S. District Judge Ralph E. Tyson.
Robinson was shot in December 2008 after officers responded to an early-morning security alarm at the Splash nightclub in the 2100 block of Highland Road.
In his lawsuit, Robinson said he was asleep on a second-floor couch when Officers Doug Chutz, Scotty Canezaro and Jake Chustz confronted him and fired their weapons.
Robinson contends the officers used excessive force in the incident.
Police spokesman Sgt. Don Kelly, however, said at the time the officers identified themselves and issued commands to Robinson before he fired at them. Chutz and Chustz returned fire and wounded Robinson, police said.
None of the officers was hit.
Police spokesman Cpl. L’Jean McKneely said Monday that none of the officers was disciplined as a result of the incident.
All three remain with the police force, McKneely added.
Neither McKneely nor Parish Attorney Mary Roper would discuss Robinson’s allegations.
“I really can’t comment at this point,” Roper said.
Robinson’s attorney, Kelly E. Balfour, said his client returned to his job at Splash after his release from a hospital.
